1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Xogos Gaming LLC ("Company," "we," "us," or "our") governing your access to and use of the SocialHub platform, including our website, applications, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

SocialHub is a social media management platform that enables users to:

• Connect and manage multiple social media accounts from a unified dashboard
• Compose, schedule, and publish content across connected platforms
• Analyze engagement and performance metrics
• Collaborate with team members on content creation and approval
• Generate AI-assisted content suggestions
• Create QR codes and track links

3. Account Registration

To use our Services, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4.2 Billing

We may offer free trials. At the end of a trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

8. AI-Generated Content

You are responsible for reviewing, editing, and approving all content before publication. We do not guarantee the accuracy, originality, or appropriateness of AI-generated content.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XOGOS GAMING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Xogos Gaming LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Services, your content, or your violation of these Terms.
